International audience ; This communication addresses a proven historical controversy between great French jurists on the point of knowing whether or not a woman can arbitrate a dispute, present in legal doctrine without discontinuity from the medieval period until the beginning of the 20th century to identify its links with the entry of women into the judiciary by the law of April 11, 1946 which allows access to positions 'for either sex'.The identified practice of women in arbitral procedure in the medieval period, marked by the decretal Dilecti filii of Innocent III of 1202 which authorized it, is discussed through the prism of Roman law which prohibits it. The condemnation by the jurisprudence of Parliaments of the rare hypotheses of female arbitration at the dawn of the 17th century does not detract from the interest of this deployment of the discourse in the modern era when it is now without practical impact. Far from being singular, the approach which consists of considering the controversy precisely from the moment when it is deprived of any application highlights the doctrinal exchange and allows us to identify an archeology of this conquest by situating it in the long term, where it is more common to only deal with it from the end of the 19th century. ; Cette communication part d’une controverse historique avérée entre grands juristes français sur le point de savoir si une femme peut ou non arbitrer un litige, présente dans la doctrine juridique sans discontinuité de la période médiévale jusqu’au début du XXème siècle pour en identifier les liens avec l'entrée des femmes dans la magistrature par la loi du 11 avril 1946 qui permet l'accès aux fonctions 'à l'un et l'autre sexe' .
