CRIMEA AND THE RIGHT TO SELF-DETERMINATION: QUESTIONING THE LEGALITY OF CRIMEA'S SECESSION FROM UKRAINE

I. Introduction On March 6, 2014, the Crimean Supreme Council adopted Resolution No. 1702-6/14 manifesting Crimea's intent to join Russia as a federal subject and scheduling an all-Crimean secession referendum. 1 On March 11, 2014, the Crimean Supreme Council and the Sevastopol City Council adopted a declaration of independence from Ukraine, in essence preempting the results of the referendum. 2 The referendum was held on March 16, 2014, and the ballot noticeably lacked a status quo option, offering the voters only the following two options: "(1) Do you support the reunification of Crimea with Russia on the rights of the Russian Federation?; and (2) Do you support the restoration of the 1992 Constitution of the Republic of Crimea and Crimea's status as part of Ukraine?" 3 However, even restoration of the 1992 Crimean Constitution would have entitled Crimea to independently establish relationships with other nations. 4 Therefore, regardless of the choice of the voting public, Crimea could break away from the rest of the Ukrainian nation by virtue of the independence declaration signed only days earlier. 5 Approximately 96.6% of the Crimean people reportedly voted to join the Russian Federation, 6 making Crimea's separation from the rest of Ukraine a unilateral secession. The right to unilateral secession allows a minority population to separate a part of the territory of the parent state due to being subjected to extreme persecution or being internally unable to realize their right to self-determination. 7 A right to self-determination ...
